Appellate Court Rules NY Medicaid Late Notice Not Moot

In a class action suit that alleged inadequate notice of temporary Medicaid benefits and illegal delays in processing applications, an intermediate appellate court recently ruled 4:1 that the case was not moot and exhaustion of administrative remedies was not required.  Coleman v. Daines, __ N.Y.S.2d __, 2010 WL 5111427 (N.Y.A.D. 1 D).
